There are two major federal statutes that regulate the conduct of gambling. These are the Wire Act and the Travel Act. These laws regulate the transmission of information over the Internet and prohibit unlawful gambling. However, the definition of unlawful Internet gambling under the Wire Act appears to be expansive. For example, the Wire Act prohibits illegal gambling on contests or sporting events. It also prohibits the illegal distribution of tickets to lottery games.
In addition to the Wire Act, the Travel Act prohibits players from using facilities or channels to engage in illegal gambling while traveling across state lines. This law also requires that gambling establishments adhere to age restrictions and a prohibition on selling or advertising alcohol to minors. Several cases have been filed against internet gambling operators that have violated these laws.
Despite the fact that these laws are in place, gambling is prevalent in the United States. In the 1990s, the Internet appeared to be a thriving, open-ended way to gamble. With the advent of computer technologies, it seemed that gambling could be played anywhere, from a coffee shop to the comfort of a home. However, there is a growing concern that these technologies will allow casinos to enter the homes of consumers. Ultimately, this poses a threat to the privacy and safety of consumers.
As online gambling becomes more popular, the government is examining the laws governing it. Many questions have arisen, particularly with regard to the use of the Commerce Clause to govern the activity. While the Commerce Clause is a powerful tool that is used by Congress to limit certain commercial activities, it has been challenged on constitutional grounds. Specifically, the First Amendment’s guarantee of free speech has been raised. Nevertheless, there have been no major successes to date.
Another legal issue that has come to light is the UIGEA. Among other things, the Unlawful Internet Gambling Enforcement Act (UIGEA) is a Congressionally mandated law that regulates commercial activity. Moreover, it includes factors to help weed out low-level gambling cases.
Other laws that have been enforced against online gambling include the Racketeer Influenced and Corrupt Organizations (RICO) provisions. Essentially, these criminal statutes prevent a person from operating a gambling business or allowing another to do so. Those operating an illegal gambling business can face fines and imprisonment. If a gambling operation is based in an offshore jurisdiction, it may be legally impossible for the U.S. Attorney General to prosecute the business.
Although federal legislation is a necessary safeguard against gambling violations, some individuals and businesses have argued that the law impedes free speech. These attacks have mainly been based on the Due Process Clause.
